In short
- Mangroves are protected in Florida. Trimming and removal are regulated, even on your own lot.
- A homeowner may trim a shoreline fringe 10 feet tall or less without a permit, if it is not cut below 6 feet and not defoliated.
- Taller trees, or trees outside the fringe, need a professional mangrove trimmer.
- Removal is not covered by the trimming exemptions. Mangroves growing into a seawall have their own repair provision: call DEP first.

If you own a saltwater canal lot, mangroves near your Cape Coral seawall can push on the cap, crowd the dock or block the view. Before you or a crew cut anything, know the state rules. This page is general information from Florida Department of Environmental Protection (DEP) guidance. We are a referral service, not a contractor or law office.
The state rule in four numbers
Heights are measured from the substrate, where the trunk meets the ground, even when that point is underwater. These figures come from DEP's mangrove FAQ.
Which situation are you in?
| Situation | What DEP guidance says | Who does it |
|---|---|---|
| Fringe, 10 ft or less | Exempt if not cut below 6 ft and not defoliated. | Homeowner |
| Taller than 10 ft | May still be exempt, but a professional trimmer is needed. | Professional mangrove trimmer |
| Outside a shoreline fringe | A permit and a professional trimmer are needed. | Professional mangrove trimmer |
| Cutting below 6 ft | Individual permit; mitigation may be required. | Apply to DEP first |
| Removing a tree | Not covered by the trimming exemptions; individual permit, mitigation may be required. | Apply to DEP first |
Watch out: "Just clear it before the crew arrives" is how owners end up needing a permit after the fact. Get the answer from DEP in writing before any cutting.
Mangroves growing into the wall
DEP's FAQ describes two practical exemptions. Mangroves inside the footprint of a docking structure, and branches hanging over a dock that block access, may be altered. Mangroves growing into a seawall may be altered as part of seawall maintenance or repair.
DEP asks you to contact your district office with a description and pictures before starting. Whether your tree qualifies depends on where it stands, so get that answer in writing.
How to handle it with your seawall project
- Photograph the shoreline
Take dated shots of every mangrove near the wall, dock and returns, with something in frame for scale.
- Ask each bidder who handles mangroves
Have the bid say whether trimming is included, who hires a professional trimmer, and what happens if a state permit is needed.
- Contact DEP before work starts
Send the description and photos to the district office that covers Lee County.
- Schedule around the season
Trimming is best October through March. Ask whether that fits the wall timeline.
- Keep the paperwork
File DEP's reply with your permit papers. It matters when you sell.
Questions to ask the contractor
- Is mangrove trimming or alteration in the price, or excluded?
- Do you use a professional mangrove trimmer, and who hires them?
- Have you contacted DEP about trees touching my wall, and can I see the reply?
- Who pays if DEP requires a permit or mitigation?
- Will in-water work carry manatee conditions that affect the schedule?

Frequently asked questions
Can I trim mangroves on my Cape Coral canal without a permit?
Florida lets homeowners trim without a permit if the mangroves are in a shoreline fringe that does not extend more than 50 feet toward the water, are no more than 10 feet tall, and are not cut below 6 feet or defoliated. Taller trees, or trees outside the fringe, call for a professional mangrove trimmer. Confirm your situation with the Florida Department of Environmental Protection before cutting.
Can I remove a mangrove that is growing into my seawall?
The trimming exemptions do not cover removal. Florida DEP says mangroves growing into a seawall may be altered as part of seawall maintenance or repair, and it asks you to contact your district office with a description and photos before starting. Do not assume your contractor can clear them without that step.
When is the best time to trim mangroves?
DEP says trimming is best done from October through March, when growth is lowest. That overlaps with many seawall schedules, so ask your contractor to coordinate.
Who is responsible for mangrove rules during a seawall job?
The permit holder and the people doing the work both carry risk, so settle it before you sign. Ask in writing who handles mangrove trimming or alteration and who pays if a state permit is needed.
Do manatees affect seawall work?
In-water work can carry manatee protection conditions set through state and federal permit review. See our seawall permits guide for how those conditions show up in a schedule.
