Pool, Cage and Deck Setback Checker for Cape Coral Waterfront Lots

A pool, screen cage or deck planned 8 ft from the rear lot line is 2 ft short of the 10 ft rear setback in Cape Coral's Land Development Code table. At 12 ft it meets the table, but anything within about 15 ft of the wall still deserves an engineer's look.

In short

  • A pool setback checker compares your planned distance with the 10 ft rear and 7.5 ft side setbacks that Cape Coral's Land Development Code lists for pools, screen cages and unenclosed decks.
  • The code measures from the property line. On many canal lots that line sits near the wall, but your survey decides, so check where it falls.
  • Pools and cages are not allowed in utility or drainage easements, and the 7.5 ft side setbacks narrow the usable width.
  • A pool 8 ft out is short; one 12 ft out meets the table. Close to the wall, the question shifts from zoning to load.

This pool setback checker is for Cape Coral waterfront owners who want a quick pass or fail before drawing a pool, screen cage or deck close to the seawall. It applies the rear and side setbacks from the city’s Land Development Code accessory-structure table to your numbers, and uses no prices. Our guide to building a pool or patio near a seawall covers the permit and wall side. This is general information, not legal advice.

1. What are you building?

Pick the closest match. An enclosed pool is measured from the outside of the screen or fence; an open pool from the waterline.

2. Your numbers

Use the closest point of the structure to the rear lot line on your survey. If the survey puts the line at the seawall, that is the same number.

Example: a pool 8 ft from the rear lot line. Illustrative numbers, not a recommendation.

How the check works

  1. Pick the structure.

A pool, a screen cage, an unenclosed deck and other accessory structures (a shed, gazebo or pergola) all list the same 10 ft rear setback in the code table. The notes differ.

  2. Enter the distance.

Measure from the closest point of the structure to the rear lot line. For an enclosed pool, use the outside of the screen or fence.

  3. Compare with 10 ft.

At 10 ft or more, the plan meets the table. Below 10 ft, it is short and needs a redesign or a variance conversation with the city.

  4. Optionally add the lot width.

Subtracting 7.5 ft on each side shows how much width the structure has.

  5. Check the wall-load flag.

Inside 15 ft of the lot line we flag the plan for an engineer. That 15 ft is our planning assumption, not a code number.

From Table 5.2.1.A of the Land Development Code, measured from the property line. Pools are not allowed in the front yard. The city decides; the edition we read may have been amended.

Pools near the wall can load it

Meeting the setback does not make the wall safe. A full pool, wet soil and equipment add weight and water behind the wall. Ask the pool engineer and a marine contractor to confirm the wall can take it before digging. Our seawall design standards guide explains what the city requires of the wall itself.

If the wall is old, leaning or has voids, repair or replace it first; a crew may need access from the yard. See building near a seawall and seawall inspection for a canal home.

Questions to ask your pool or cage builder

  • Which line is the setback measured from on my lot? Ask them to mark the rear lot line and any easements on the site plan.
  • Does the plan show the seawall cap line? Cape Coral permit site plans must show existing seawalls.
  • Who confirms the wall can carry the pool? Get the engineer's name and a written statement.
  • Is a variance or a smaller design needed? Ask before you sign a contract.

Frequently asked questions

How far must a pool be from the rear lot line in Cape Coral?

The accessory-structure table in the Land Development Code lists a 10 ft rear setback and a 7.5 ft side setback for swimming pools, pool screen enclosures and unenclosed decks, measured from the property line. An enclosed pool is measured from the outside of the screen or fence; an open pool from the waterline. Confirm with Development Services for your lot.

Is the setback measured from the seawall or from the property line?

The code table says setbacks are measured from the property line. Some local pool builders describe separate distances measured from the seaward side of the seawall, and a permit-guide site cites 20 ft from the seawall cap. We could not confirm either in the code text, so your survey and the city decide which line applies to your lot.

Does the lot width matter?

Mostly through the side setbacks: 7.5 ft on each side leaves the structure a band of the lot width minus 15 ft. The checker shows that band if you enter a width.

Can I build a pool or cage in an easement?

No. The code says pools, spas, hot tubs, pool enclosures and screen enclosures are prohibited in public utility or drainage easements. Your survey shows any easements along the rear or sides.

Will the seawall hold up a pool built close to it?

That is an engineering question, not a setback question. Digging and a full pool add load behind the wall. Ask the pool engineer and a marine contractor to say in writing whether the wall is adequate before the pool is dug.
