In short
- This flagpole, solar array, fountain and swing set rules calculator checks your plan against the setback, height and count limits in Cape Coral's Land Development Code.
- Heights are capped at 35 ft for a flagpole, 12 ft for a fountain or sculpture, 8 ft for a swing set and 6 ft for a residential ground solar array.
- Swing sets and ground solar arrays cannot go in the front yard. A residential site is limited to two flagpoles.
- Ground solar collectors may cover no more than 5 percent of the lot area, and the frame may not use unfinished lumber.
On this page
This flagpole, solar array, fountain and swing set rules calculator is for Cape Coral owners adding a yard extra, often in the backyard next to a canal and a seawall. It applies Table 5.2.1.A and Sections 5.2.8, 5.2.9, 5.2.12 and 5.2.14 of the Land Development Code to your numbers, and uses no prices. Sheds, gazebos and fences are in our shed, gazebo and fence rules calculator. This is general information, not legal advice.

Example: a swing set in the rear yard, 5 ft from the rear property line and 9 ft tall. Illustrative choices, not a recommendation.
How the check works
- Pick the item and the yard.
Choose what you are adding and which yard it goes in. Front-yard swing sets and ground solar fail at once.
- Enter distance and height.
Measure to the property line on your survey and to the highest point of the structure.
- Add the count or solar share if they apply.
Flagpoles are counted per lot. Ground solar also has a 5 percent coverage limit.
- Read each row and the notes.
Each row shows meets, confirm or fails. Confirm means the code text and its table do not agree.
Limits the checker uses
| Item | Limit | Source |
|---|---|---|
| Flagpole | 15 ft front, 7.5 ft side, 10 ft rear; 35 ft high; two per residential site | Table 5.2.1.A; 5.2.8 |
| Fountain or sculpture | 15 ft front, 10 ft side, 10 ft rear; 12 ft high | Table 5.2.1.A; 5.2.9 |
| Swing set, play structure | Not in front yard; 7.5 ft side, 6 ft rear; 8 ft high | Table 5.2.1.A |
| Ground solar array | Not in front yard; 7.5 ft side, 10 ft rear; 6 ft high; up to 5% of lot | 5.2.14.C.3 |
Ground solar is the one place the code disagrees with itself: Section 5.2.14.C.3 allows arrays up to 6 ft in height, while Table 5.2.1.A lists 9 ft. The checker passes 6 ft or less, marks 6 to 9 ft as confirm, and fails anything taller. Rooftop panels, reflecting-pool depth and the fountain height cross-reference in the table are not tested here.
Where it can go wrong
A 6 ft ground solar array can surprise owners. A panel frame sized for good sun can be taller than the residential cap, and the 5 percent coverage limit applies on top. Ask your installer for the frame height and collector area in writing before you buy.
A flag standard does not need a permit, but a freestanding pole near a lot line still has to meet the setback. Play equipment on a single-family or duplex lot is not permitted or inspected by the city, and the table setbacks still apply.
Near the seawall
The rear line on a canal lot is on the water side. A flagpole or swing set near the seawall cap is close to that line and to the wall's load zone. Keep heavy footings away from the cap; our guide to building near a seawall explains why.
For the wall side, read our guide to building near a seawall and the seawall permit guide.
Questions to ask before you build
- Where exactly is my property line? Ask for your survey. Measure from it, not from the house or the water.
- What is the real height? For solar, ask for the frame height and the collector area as a share of the lot.
- Do I need a permit? A flag standard does not; larger poles, solar and fountains may. Ask Development Services.
- Is there an easement? Do not build over a utility or drainage easement on your survey.
Next step: get a written quote
This tool checks yard-extra rules, not the job. We are a referral service, not a contractor; we connect visitors with independent local providers. Use the form below to ask independent local seawall contractors for a written quote, and read how to choose a seawall contractor first. More tools are in our free calculators list.

Frequently asked questions
How tall can a flagpole be in Cape Coral?
Section 5.2.8.C caps flagpoles at 35 feet, except on non-residential property abutting Pine Island Road. A residential site is limited to two flagpoles (5.2.8.A). Table 5.2.1.A also sets a 15 ft front, 7.5 ft side and 10 ft rear setback from the property line.
Do I need a permit for a flag standard?
Section 5.2.8.D says a flag standard does not need a permit, and the number of flags on a pole or standard is not limited. A tall flagpole is a different question, so ask Development Services before you set a footing.
Can I put ground-mounted solar panels in my front yard?
No. Section 5.2.14.C.3.c does not allow at-grade solar arrays in the front setback or front yard of a residentially zoned lot. Side lines need 7.5 ft and rear lines 10 ft, the array may be up to 6 ft tall, and the collector area may not exceed 5 percent of the lot area.
How tall can a fountain or statue be?
Section 5.2.9.A caps fountains and sculptures at 12 feet. A reflecting pool deeper than 24 inches must be fenced for safety (5.2.9.B). Table 5.2.1.A sets the setbacks at 15 ft front, 10 ft side and 10 ft rear.
Does the city permit a backyard swing set?
On single-family detached and duplex lots the city does not permit or inspect play equipment (Section 5.2.12.A). Table 5.2.1.A still sets where it may stand: not in the front yard, 7.5 ft from side lines, 6 ft from the rear line, and no higher than 8 ft.
